Utah v Brian David Mitchell (3rd Judicial District Court 2005).

On June 5, 2002, a man kidnapped Elizabeth Smart while her sister watched. On March, 12, 2003, Brian David Mitchell was arrested while with Smart. In June, he was sent for evaluation to the forensic unit of Utah State Hospital. Competency to stand trial proceedings started in 2005. After three mental health professionals testified, Mitchell was found incompetent, and is still hospitalized. In this decision, Judge Judith Atherton reviews Mitchell's life and religion. The testifying doctors disagreed on whether Mitchell's religious notions were extreme beliefs or delusions. After considerable discussion on the difference, the judge held that Mitchell's notions were delusions and Mitchell was therefore mentally ill, and incompetent. (editor's abstract)
